On November 16, 2016, New York City Mayor Bill De Blasio signed into law a bill that will provide more wage protection to freelance workers. Under the Freelancer Isn’t Free Act, which goes into effect in May 2017, freelancers/independent contractors living in NYC would be entitled to the right to:
- Have a written contract containing certain provisions, like the name and mailing address of the hiring party and freelancer, if the value of services is $800 or more;
- Be fully and timely paid according to the contract or, if no date is specified in the contract, no later than 30 days after the freelancer has completed services; and
- Be free from retaliatory action by hiring party.
Those who hire freelancers should be sure to comply with this new law because there are severe penalties: repeat violators could pay a penalty of up to $25,000.
